1986, unless it is clearly proven that the main intention behind purchasing the property was commercial profit-making.<\/p>\n<p>In other words, leasing out your apartment does not mean you automatically lose your right to file complaints for issues like:<\/p>\n<ul>\n<li>delayed possession<\/li>\n<li>unfair charges<\/li>\n<li>changes in the layout plan<\/li>\n<li>deficiency in services<\/li>\n<li>excess demand notices<\/li>\n<li>refund disputes<\/li>\n<\/ul>\n<p>The Court firmly stated:<\/p>\n<p>\u201cThe mere factum of leasing out the flat does not, by itself, demonstrate that the appellants purchased the property with the dominant purpose of engaging in commercial activity.\u201d<\/p>\n<h2><span class=\"ez-toc-section\" \u201cconsumer\u201d because the flat was rented out, then the developer must establish that the buyer\u2019s dominant purpose was commercial.<\/p>\n<p>The Court observed:<\/p>\n<p>\u201cThe onus of proving that the appellants fall within the exclusion clause&#8230; rests upon the respondents.\u201d<\/p>\n<p>Since the developer failed to prove this claim, the buyer could not be excluded from the purchasing immovable property, even in multiple units, does not automatically fall under the \u201ccommercial purpose\u201d exclusion.<\/p>\n<p>The Court noted that whether something is commercial or not depends entirely on the facts of the case.<\/p>\n<p>It stated that the act of purchasing property cannot <em>ipso facto<\/em> (by itself) be considered commercial unless the dominant purpose is class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>This Supreme Court decision came in a case involving homebuyer <strong>Vinit Bahri<\/strong>, who challenged an order passed earlier by the National Consumer Disputes Redressal Commission (NCDRC).<\/p>\n<p>The NCDRC had dismissed Bahri\u2019s complaint stating that he was not a \u201cconsumer\u201d because he had rented out the apartment, treating it as a commercial transaction.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Project_Details\"><\/span><strong>Project Details<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><strong>The case involved MGF Developers Limited, which launched a group housing project named \u2018The Villas\u2019 in:<\/strong><\/p>\n<ul>\n<li>Sahraul village<\/li>\n<li>Sector 25<\/li>\n<li>Gurugram<\/li>\n<li>Year of launch: 2005<\/li>\n<\/ul>\n<p>In March 2005, Bahri paid a booking amount of \u20b915 lakh and was allotted a unit on September 2, 2005.<\/p>\n<p>The unit was located on the ground floor of Tower-C with a super-built-up area of 3,590 sq ft.<\/p>\n<p><strong>Buyer\u2019s Complaint: Layout Changes and Repeated Extra Demands<\/strong><\/p>\n<p>According to reports, Bahri alleged that the developer:<\/p>\n<ul>\n<li>changed the layout plan later<\/li>\n<li>raised repeated demands for additional money<\/li>\n<li>forced payments despite protest<\/li>\n<\/ul>\n<p><strong>Possession was finally taken by him on January 8, 2015, meaning the delay was substantial.<\/strong><\/p>\n<p>After taking possession, he approached the NCDRC seeking:<\/p>\n<ul>\n<li>compensation for delayed possession<\/li>\n<li>refund for the excess amount charged<\/li>\n<li>additional costs and damages<\/li>\n<\/ul>\n<h2><span class=\"ez-toc-section\" class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>The developer argued that Bahri had purchased the flat for commercial purposes and also rented it out to another person in March 2015.<\/p>\n<p>Based on this, the builder claimed he was not eligible for consumer protection rights and that the complaint should be dismissed.<\/p>\n<p>However, the Supreme Court rejected this reasoning and overruled the relocation<\/li>\n<\/ul>\n<p>The Supreme Court\u2019s decision ensures that such buyers are still protected under consumer law.<\/p>\n<p>It strengthens the position of homebuyers against builders who a builder can prove that the buyer purchased the property primarily for commercial business activity, the buyer remains a consumer and can seek justice under consumer protection laws.
