Rakesh Jain and Ors.<\/span><\/i><span style=\"font-weight: 400;\">, where a woman filed a partition suit over her late grandfather\u2019s property in Janakpuri, West Delhi. She argued that the property was \u201cancestral\u201d and that she was entitled to a share of her father\u2019s inherited portion.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Her father, however, contended that the property devolved only upon him and his sister (the deceased\u2019s children) under Section 8 of the Hindu Succession Act, making it his absolute property.<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"Courts_Key_Findings\"><\/span><strong>Court\u2019s Key Findings<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Justice Purushaindra Kumar Kaurav, rejecting the woman\u2019s claim, made the following observations in his verdict:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Section 8 of HSA, 1956 applies:<\/b><span style=\"font-weight: 400;\"> If a Hindu male dies without a will (intestate), his property devolves strictly on Class I heirs\u2014widow, sons, daughters, and mother.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Grandchildren are not Class I heirs:<\/b><span style=\"font-weight: 400;\"> Unless their parent (the son or daughter of the deceased) has already passed away, grandchildren cannot claim a share.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Inheritance is absolute, not ancestral:<\/b><span style=\"font-weight: 400;\"> The share a child receives from a deceased parent becomes their own property, not a joint family or ancestral property.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">The judge concluded that since the woman\u2019s father was alive when her grandfather died, the property devolved solely upon him and his sister. Therefore, the daughter had no rightful claim.<\/span><\/p>\n<blockquote><p><strong>Also Read: <a laws.<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>No automatic inheritance for grandchildren:<\/b><span style=\"font-weight: 400;\"> Sunil Tyagi, Managing Partner at ZEUS Law Associates, noted that grandchildren can only inherit if their parent (a Class I heir) dies before the grandparent.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Shift from traditional notions of ancestral property:<\/b><span style=\"font-weight: 400;\"> The Hindu Succession Act, 1956, significantly changed how property devolves, making self-acquired property of the heir
