However, the authority clarified that:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The <\/span><b>refund would be processed without interest<\/b><span style=\"font-weight: 400;\">, in accordance with the terms of the original agreement.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The <\/span><b>buyers must execute cancellation deeds<\/b><span style=\"font-weight: 400;\"> after receiving the refund, within 30 days from a mutually convenient date.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">MahaRERA <\/span><b>cannot modify<\/b><span style=\"font-weight: 400;\"> the agreed contractual clauses at this stage.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Importantly, this order does <\/span><b>not set a precedent<\/b><span style=\"font-weight: 400;\"> for refund with interest in situations where buyers default on payments. In fact, the Authority emphasized that <\/span><b>the terminations were legally valid<\/b><span style=\"font-weight: 400;\"> and that there was <\/span><b>no delay in project delivery<\/b><span style=\"font-weight: 400;\"> on the part of the developer.<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"Why_Were_the_Buyers_Seeking_Refunds\"><\/span><b>Why Were the Buyers Seeking Refunds?<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">The six homebuyers, who had invested a combined \u20b96.21 crore towards seven flats in the Godrej RKS development\u2014valued collectively at \u20b928.8 crore\u2014approached MahaRERA citing:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Severe <\/span><b>financial and personal hardships post-COVID-19<\/b><span style=\"font-weight: 400;\">.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Termination letters received from the developer, informing them that their booking amounts were forfeited.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Difficulties in <\/span><b>reselling their units<\/b><span style=\"font-weight: 400;\">, due to delayed or no response from Godrej Properties.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">One buyer even alleged that they were pressured to shift their booking to another Godrej project, despite no such clause existing in the original application. Another claimed they never signed a sale agreement and only had an allotment letter issued in 2020.<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"How_Did_Godrej_Properties_Respond\"><\/span><b>How Did Godrej Properties Respond?<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">In its response, Godrej Properties strongly defended its actions, stating that:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Buyers had <\/span><b>defaulted on scheduled payments<\/b><span style=\"font-weight: 400;\"> linked to construction milestones.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">In several cases, <\/span><b>termination notices were issued between August 2021 and July 2023<\/b><span style=\"font-weight: 400;\"> after continued non-payment.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">There was <\/span><b>no delay in possession<\/b><span style=\"font-weight: 400;\">\u2014the Occupancy Certificate (OC) was granted in <\/span><b>December 2023<\/b><span style=\"font-weight: 400;\">, well before the June 2024 deadline.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">One of the buyers had <\/span><b>already booked another apartment<\/b><span style=\"font-weight: 400;\"> in their Godrej Urban Park project, thus rendering the original complaint invalid.<\/span><\/li>\n<\/ul>\n<p>The developer also pointed out that certain complainants had filed duplicate complaints. Misusing the legal system, and argued that any relief beyond the existing contract terms was outside MahaRERA\u2019s jurisdiction.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"What_Does_the_Law_Say\"><\/span><b>What Does the Law Say?<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">As per the <\/span><b>Real Estate (Regulation and Development) Act, 2016<\/b><span style=\"font-weight: 400;\">, developers are allowed to terminate bookings and forfeit amounts under certain conditions, provided they follow the terms outlined in the signed agreements.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">MahaRERA reiterated that while it sympathizes with the buyers&#8217; situation. Founded by iconic actor-filmmaker Raj Kapoor in 1948. The studio witnessed the production of some of India&#8217;s most memorable films before it was sold in May 2019. By the Kapoor family to Godrej Properties for an estimated \u20b9250 crore.<\/p>\n<p><span style=\"font-weight: 400;\">Set on a <\/span><b>2.2-acre land parcel<\/b><span style=\"font-weight: 400;\"> in Chembur, the Godrej RKS project was launched in <\/span><b>January 2020<\/b><span style=\"font-weight: 400;\"> as a luxury residential offering featuring \u201cCollector\u2019s Edition\u201d 3 and 4 BHK apartments. The architecture of the project pays tribute to <\/span><b>Bombay Art Deco<\/b><span style=\"font-weight: 400;\">, echoing the studio\u2019s cinematic legacy.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The project is registered with MahaRERA and has a scheduled completion date of <\/span><b>December 2024<\/b><span style=\"font-weight: 400;\">.<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"What_Happens_Now\"><\/span><b>What Happens Now?<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Godrej Properties<\/b><span style=\"font-weight: 400;\"> must refund all amounts received from the concerned buyers within <\/span><b>60 days<\/b><span style=\"font-weight: 400;\">.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Upon refund, the <\/span><b>buyers must execute cancellation deeds within 30 days<\/b><span style=\"font-weight: 400;\">.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">There will be <\/span><b>no interest payable<\/b><span style=\"font-weight: 400;\"> on these refunds.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Both parties are expected to <\/span><b>mutually cooperate<\/b><span style=\"font-weight: 400;\"> to complete this process.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">The developer\u2019s final stance remains that it has complied with all legal obligations and has not defaulted on delivery timelines.
